 Collaboration

Collaborative family law has been developed to promote the resolution of family issues in a manner that reduces the conflict rather than increases it.

Each spouse retains a family lawyer who trained to work in the collaborative model. Initially, each spouse meets with their own lawyer to establish a relationship, explore issues and concerns and obtain information. A four way meeting will then be scheduled at one of the lawyers offices. The lawyers and each spouse will sign a Participation Agreement that sets out the fundamentals of collaborative law.

The foremost term is that the parties are agreeing in good faith to resolve their issues out of court. If the process does not result in an resolution then neither of the collaborative lawyers will be involved in litigation.

During the four way meetings, both lawyers will work together to assist the spouses in understanding each other's concerns and explore a wide range of possible solutions. The goal is to reach agreements on issues that are acceptable to both spouses.

After the first four way meeting further meetings will be scheduled as needed to resolve the issues. Once the issues are resolved a Separation Agreement is drafted and signed. An Uncontested Divorce can be proceeded with depending on the wishes of the couple.

Divorce coaches, financial specialists and child specialists are available to bring into the process depending on the issues and concerns.

Divorce coaches are mental health professionals who help family members improve communication and provide support for the emotional aspects of divorce.
